01. General
FLO Coaching was founded by Floris Wolswijk and Lotte Merijn Boekhout. The trajectories at Floris Wolswijk are carried out by Blossom ACT BV (Blossom). Blossom was founded by Floris Wolswijk, is located in Anna Paulowna, and is registered with the Chamber of Commerce under number 64496929.
02. Definitions
- Contractor: FLO Coaching
- Coach: Floris Wolswijk, owner of Blossom.
- Client: The individual of 21 years or older who engages in a guidance trajectory with the coach.
- Principal: The company or institution that has one or more employees receive guidance from the coach and is therefore responsible for the payment of the guidance.
- Truffles: the legally available sclerotia of fungi in stores in the Netherlands that contain the psychoactive substance psilocybin.
03. Applicability
The general terms and conditions are applicable to all oral and written agreements with FLO Coaching, and the related actions.
04. Coaching Trajectory
- The coach offers professional guidance to healthy adults who wish to use psilocybin truffles in a safe context.
- A coaching trajectory at FLO Coaching consists of:
- An online screening and introductory conversation with which the coach assesses whether an experience with truffles is safe and suitable for the client.
- One or more preparatory conversations in which the coach explains the session and the effects of the truffles. The client can discuss their expectations, questions, and intentions for the session.
- The guided truffle session, which takes 6 to 9 hours, during which the coach creates and ensures a safe environment and is present all day for the client. The day starts with a pre-discussion (before the client takes the truffles) and ends with a debriefing (after the truffles have worn off).
- A brief contact moment (via SMS, WhatsApp) the day after the session, to gauge how the client is doing.
- One or more integration talks in which the client can debrief their experiences and where the coach provides tips for integrating the experience.
- A coaching trajectory does not include:
- Preparing the truffles in any way. The truffles are consumed fresh as they come from the store.
- Offering illegal alternatives to truffles.
- Transporting the client. The client themselves must arrange transportation back home after the session. Once the truffles have worn off, participation in traffic is allowed (i.e., no legal violation) but not advisable (due to possible fatigue and sensitivity). This logistical point is discussed during the preparatory conversation.
- Providing aftercare after the last concluding integration talk.
- Prior to the preparatory conversations, an online screening and acquaintance take place. This screening involves a questionnaire that the client fills out online. A medical screening is part of this intake and includes several questions about, among other things, the client’s medical history and possible medication use. Based on the screening and acquaintance, the coach determines whether participation is appropriate and safe for the client. If participation is discouraged or denied by the coach at this stage, the coaching trajectory is nullified. The client is not obliged to make any payment.
- The above description of the coaching trajectory only applies to one-on-one sessions and duo sessions. Different trajectory descriptions apply to group sessions, which the coach shares with the participants each time.
05. Confidentiality and Privacy
- The client and the coach are obligated to maintain confidentiality of all confidential information they have obtained from each other or from another source within the framework of their agreement. Information is considered confidential if it has been communicated by the other party or if it arises from the nature of the information.
- The coach reserves the right to breach confidentiality if a (medical) emergency occurs during the session and the coach feels compelled for their own safety or that of the client to share confidential information with third parties, such as medical personnel, but not limited to them.
- The coach ensures the privacy of the client and handles the information provided by the client carefully. A detailed description of which data are collected and when they are destroyed can be found in the privacy statement of FLO Coaching.
06. Audio Recording
- For safety considerations, an audio recording can be made of the guided truffle session in consultation with the client. This MP3 recording is made with a voice recorder that is not connected to the internet. The recordings are stored offline. By participating in a guided truffle session, the participant agrees to the making of this recording. Preparatory and integration talks are not recorded.
- The client can request a copy of the audio recording after the session if desired. The MP3 file can be sent via WeTransfer upon request. The client is not permitted to share or distribute the recording online without explicit permission from the coach.
07. Risk Factors
- The use of psilocybin truffles is discouraged if there is:
- Use of antidepressants or other medications that interact with truffles
- A psychiatric diagnosis / condition
- An unresolved trauma from (early) childhood
- A (family) history of psychosis
- A family member with schizophrenia
- High blood pressure or cardiovascular diseases
- Epilepsy
- Pregnancy or breastfeeding
- The above risk factors will be discussed during the introductory trajectory. It is the responsibility of the client to discuss any risk factors that apply to them with the coach and to be honest about their mental and somatic health.
- The coach is not a doctor or psychotherapist and cannot provide appropriate guidance and/or aftercare in the event of underlying mental and/or psychiatric issues and/or somatic complaints.
- The trajectories offered by FLO Coaching cannot be considered as (a replacement for) medical or psychiatric consultations and treatments.
08. Liability and Responsibility
- The coach will perform his/her duties to the best of his/her insight and ability. The coach has an obligation to make an effort, not an obligation to achieve a result. The guidance from FLO Coaching is result-oriented but does not guarantee the solution or the result. The responsibility for achieving the goals and the result lies with the client, and nobody else.
- The client enters the truffle session at his/her own risk and responsibility. This means that the client takes full responsibility for his/her experience during the sessions and the consequences thereof. The coach cannot anticipate or control the effects of the psilocybin experience, and the client bears the risks associated with psychedelic use. The client has the option to withdraw the decision to consume psychedelic truffles until the moment of intake.
- Participation is entirely at your own risk. The coach accepts no liability for any somatic and/or psychological complaints that arise through or in connection with the services performed, unless the damage is a direct result of intentional or deliberate recklessness of the coach.
- The coach is not liable for direct or indirect damage suffered by the participant or client as a result of actions or decisions made following or during the coaching trajectory. The client remains at all times responsible for choices made.
- The coach accepts no liability whatsoever for any (indirect) damage to or loss of personal property of the participant, unless the damage is a direct result of intentional or deliberate recklessness of the coach.
- The coach accepts no liability for damage to the space or contents of the space rented in the name of the client as a location for the session, unless the damage is a direct result of intentional or deliberate recklessness of the coach.
- The coach is solely liable for compensating the damage up to a maximum of the invoice amount.
- In the event of damage to the practice space or to his/her own contents, the coach will claim on the client’s liability insurance.
09. Coaching Agreement
Truffle sessions only take place after signing a coaching agreement. By signing that agreement, the client declares to agree with the framework of the coaching assignment as set out in the signed agreement and in accordance with the general terms and conditions.
10. Refusal
- The coach reserves the right to refuse a participant if she cannot guarantee the safety of herself or the client.
- If during or after the preparatory conversations it appears that the coaching trajectory is not suitable for the client, then the coach will mention this orally and in writing if desired. The planned truffle session will be canceled accordingly. In that case, the client owes the amount for separate coaching session(s) to the coach for the expenses made and the time invested.
- The coach reserves the right to refuse to coach the client at the start of the session. For example (but not limited to), if the client comes to the session under the influence of alcohol or drugs, shows signs of psychosis or another psychiatric condition, or exhibits intimidating behavior. The truffle session will then be canceled immediately and the coach will charge the full costs.
11. Investment and Payment Conditions
- The current rates for the services provided are listed on the website www.flocoaching.nl or can be requested from the coach.
- If coaching takes place outside Anna Paulowna, the coach will charge travel costs and possibly accommodation costs. These are in addition to the amount described above. Such additional costs will be shared with the client in advance in a written quotation.
- For payment, the client will receive an invoice. The client or client is obliged to transfer the amount to the coach’s account within 14 days after the invoice date. The invoice must be paid at least one week before the guided truffle session.
- If payment is not made within the agreed term, FLO Coaching will send a payment reminder. If the payment obligation is still not met after this, FLO Coaching is forced to hand over the claims to third parties. The costs associated with this are (in accordance with the law) entirely at the expense of the client. In the absence of payment, FLO Coaching is entitled to suspend further appointments until the payment obligation has been met.
12. Cancellation Policy
- Preparation and integration talks can be canceled free of charge up to 48 hours in advance and rescheduled free of charge up to 24 hours in advance.
- If the appointment is canceled less than 24 hours in advance or if the client does not show up for the appointment, then the full amount for a single appointment will be charged.
- A guided truffle session can be rescheduled or canceled free of charge up to 14 days before. When rescheduling the guided truffle session, the client should take into account a possible waiting time for scheduling a new session.
- A guided truffle session that is canceled within 14 days before the start of the session will be charged in full. The amount for the guided truffle session will be fully invoiced and thereby the right to a refund expires.
- When rescheduling a truffle session between 14 days and 48 hours before the start of the session, the coach will charge a percentage of 25%. For cancellations within 48 hours, the coach charges a percentage of 75%. If the client does not show up on the day of the session, then the full costs will be charged.
- If the client appears on the session day but decides not to take the truffles, that is the participant’s good right. As an alternative, the coach can offer a coaching session and a relaxing meditative music journey of about 3 to 4 hours. The coach will charge a percentage of 75%.
13. Force Majeure
In the event of force majeure on the part of the coach, he/she will immediately inform the client and the client. During the period of force majeure, her obligations are suspended. In the event of force majeure, both parties have the right to unilaterally terminate the agreement by a written statement. The coach will then refund the amount already paid. Force majeure includes, but is not limited to, illness on the part of the coach.
14. Applicable Law & Professional Association
- All legal relations are exclusively subject to Dutch law. In the event of a complaint, the client or client is requested to contact the coach within 14 days after the situation.
- The coach is affiliated with the “Guild of Guides” – a professional association for guides working with legal psychedelic substances. This means that coach follows the code of conduct and ethical guidelines of the Guild of Guides and that there is a confidential advisor available through this organization for the client who feels mistreated by the coach or wishes to discuss other complaints about coach with an independent confidential advisor.
